Terms and Conditions

These Terms and Conditions (the "Terms") govern your access to and use of the GuishApp mobile application and website (the "Platform"), including its features to save, organize, comment on, and share wishes, lists, and related content (the "Services").

1. About GuishApp and the Services

GuishApp lets you save and organize links, images, notes, and other data related to products, services, or experiences ("Items"), and create personal or collaborative lists to share with friends.

Items are typically sourced from third parties (e.g., online stores or social media). GuishApp does not sell or deliver those products unless explicitly stated.

2. Acceptance and changes

We may update these Terms. The current version will be posted on this page with the "Last updated" date. Your continued use of GuishApp after an update constitutes acceptance of the changes.

3. Account registration

• You need an account to use most features.
• You must be at least 13 years old to use GuishApp. If you live in a jurisdiction where the minimum age is higher, that age applies.
• You agree to provide accurate information and keep it up to date.
• You are responsible for the confidentiality of your credentials and for all activity from your account.
• If you notice unauthorized access, notify us immediately at legal@guishapp.com.

4. Permitted use

You agree to use GuishApp lawfully and in accordance with these Terms. In particular, you agree NOT to:

• Use the Platform for illegal, deceptive, or fraudulent activities.
• Attempt unauthorized access to systems, accounts, or third-party data.
• Send spam, harvest data from other users without consent, or perform mass scraping.
• Use bots or automation that degrade the service or violate reasonable usage limits.
• Upload content that infringes copyright, trademarks, or other third-party rights.

5. Zero tolerance for objectionable content and abusive users

The following is strictly prohibited on GuishApp:

• Sexually explicit content, pornography, nudity, or any sexually suggestive material.
• Any form of content depicting or related to child exploitation or abuse. We will report such cases to the competent authorities.
• Hate speech, discriminatory content, or material targeting people or groups based on race, ethnicity, nationality, religion, gender, gender identity, sexual orientation, age, disability, or any other protected characteristic.
• Threats, harassment, bullying, intimidation, doxxing, stalking, or any conduct directed at harassing or intimidating other users.
• Violent or gore content, or content glorifying physical harm to people or animals.
• Content promoting self-harm, suicide, or eating disorders.
• Personal information of third parties published without their consent.
• Deceptive content, fraud, scams, or pyramid schemes.
• Any other content that is unlawful under applicable law.

Abusive behavior is also prohibited, including hostile messages, creating fake accounts to harass, impersonating identities, organizing harassment campaigns, or any other conduct that violates the community spirit of the Platform.

6. Moderation, reports, and 24-hour response

GuishApp provides multiple mechanisms to keep the community safe:

• Automated filtering: images uploaded to the Platform are processed by an automated system that detects inappropriate content before they become visible to other users.
• Content reporting: any user can report another user, a list, or an item from the corresponding menu inside the app. Reports are sent to our moderation team.
• Blocking users: any user can block another user at any time. Blocking instantly removes the blocked user's content from the blocker's view, cancels the friendship if it existed, and triggers an automatic notification to the GuishApp team.

24-hour response commitment: our team reviews objectionable content reports within 24 hours of receipt. If we confirm that the content or behavior violates these Terms, we will remove the content and, depending on severity, suspend or terminate the account of the responsible user without prior notice.

Moderation decisions are made at our sole discretion. Users may appeal a decision by writing to legal@guishapp.com, but the final decision rests with GuishApp.

7. User Content (links, images, lists, and notes)

"User Content" is everything you upload, save, or share on GuishApp (e.g., links, photos, notes, lists). You retain your rights to your User Content.

By using GuishApp, you grant us a limited, non-exclusive, royalty-free, worldwide license to host, process, store, and display your User Content solely to operate and improve the Services (e.g., saving a link, displaying a thumbnail, syncing lists across devices).

You are solely responsible for the User Content you post and for the consequences of doing so.

8. Third parties and links

Items may link to third-party sites. GuishApp does not control or take responsibility for the content, prices, availability, policies, or practices of those third parties. Any purchase or interaction is between you and the third party.

9. Intellectual property

The Platform (including brand, design, code, and proprietary materials) belongs to GuishApp or its licensors. You are granted a personal, limited, revocable, non-exclusive license to use the Platform in accordance with these Terms.

10. Service availability, improvements, and changes

We may modify, suspend, or discontinue parts of the Platform (temporarily or permanently) for technical, security, legal, or operational reasons. We will try to minimize impact, but we do not guarantee uninterrupted availability.

11. Disclaimer of warranties

GuishApp is provided "as is" and "as available." To the extent permitted by applicable law, we do not warrant that the service will be uninterrupted, error-free, or that third-party data (e.g., a link's title/image/price) will be accurate or always up to date.

12. Limitation of liability

To the extent permitted by applicable law, GuishApp will not be liable for indirect, incidental, special, consequential damages, or loss of opportunities arising from use of or inability to use the Service, including purchases made on third-party sites.

13. Termination

You may stop using the Platform at any time and delete your account from Profile → Delete account. We may also suspend or cancel access if we reasonably believe there has been a breach of these Terms, misuse, a security risk, a legal requirement, or publication of content prohibited under Section 5.

14. Privacy

Processing of personal data is governed by our Privacy Policy.

15. Governing law, jurisdiction, and dispute resolution

These Terms will be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict-of-laws principles, and, to the extent applicable, the federal laws of the United States.

Informal resolution: before starting a formal claim, both parties will attempt to resolve any dispute in good faith by contacting each other in writing at legal@guishapp.com and waiting a reasonable period for a response.

Arbitration: unless prohibited by law or otherwise stated, any dispute arising from or relating to these Terms or the Services will be resolved by binding arbitration in English, administered by a recognized provider (e.g., AAA) under its applicable rules. The seat of arbitration will be Wilmington, Delaware, unless otherwise agreed.

Class action waiver: to the extent permitted by law, the parties agree that disputes will be resolved on an individual basis and not as part of a class, consolidated, or representative action.

Exceptions: either party may seek injunctive or emergency relief before competent courts to protect intellectual property rights or prevent irreparable harm.
